By accessing, browsing, or utilizing the interactive business directory services provided by Apna Listing Ltd. (“Company,” “We,” “Us,” or “Our”) via apnalisting.com (the “Website”), you explicitly agree to be legally bound by the terms, disclaimers, and liability frameworks outlined below. If you do not agree to these terms, you must immediately cease using the Website.

1. NO WARRANTY AND INDEPENDENT DATA VERIFICATION

  • As-Is Directory Provision: Apna Listing Ltd. operates as a local venue, directory service, and electronic publisher of informational data. All business entries, metadata, localized operational data, hours, languages, pricing guidelines, maps, and related information are provided strictly on an “As-Is” and “As-Available” basis.
  • Third-Party Data Sourcing: Content displayed on the Website is manually curated from verified public domains, uploaded by third-party web operators, or voluntarily updated via business managers or users. We make no representations, guarantees, or statutory warranties of any kind—explicit or implied—regarding the accuracy, currency, fitness, truthfulness, or legal compliance of any directory data.
  • Independent Duty to Verify: Users explicitly acknowledge and agree that they bear the sole duty and liability to independently verify all business information directly with the individual business operator before visiting premises, engaging services, or exchanging capital.

2. COMPREHENSIVE LIMITATION OF LIABILITY

  • Exclusion of Indirect Damages: To the maximum extent permitted under the laws of British Columbia and Canada, Apna Listing Ltd., its directors, officers, employees, stakeholders, contractors, or virtual assistants shall not be held liable for any indirect, incidental, punitive, collateral, special, exemplary, or consequential damages. This includes, but is not limited to: loss of local business revenue, loss of commercial profits, reputational harm, business interruption, loss of data, personal injury, or property damage resulting from your use or inability to use the Website.
  • Financial Cap on Liability: If, notwithstanding the exclusions herein, Apna Listing Ltd. is found legally liable by a court of competent jurisdiction for any cause of action arising out of these terms or site operations, Our total aggregate financial liability to you or any third party shall not exceed One Hundred Canadian Dollars ($100.00 CAD).

3. USER-GENERATED CONTENT & INTERACTIVE REVIEW POLICY

Apna Listing Ltd. provides community interaction spaces allowing users to submit ratings, commentary, critiques, photos, and general reviews (“User-Generated Content” or “Reviews”).

  • Innocent Disseminator Status: Users and business owners explicitly acknowledge that Apna Listing Ltd. acts strictly as a neutral interactive platform operator, technological intermediary, and an “Innocent Disseminator” of third-party public expressions under Canadian law. Reviews represent the independent personal opinions and personal observations of individual platform users—they do not reflect the viewpoints, alignment, or endorsement of Apna Listing Ltd.
  • No Editorial Ownership or Alteration: To protect our platform’s legal status as a neutral publisher, We maintain a strict policy of never editing, summarizing, altering, or restructuring the semantic text of user reviews. Reviews will either remain published in their raw user-submitted state or will be deleted in their entirety if found to violate our content parameters. We are not the authors or co-authors of User-Generated Content.
  • User Indemnification Framework: Any user who writes and submits a review via our ListingPro interface explicitly warrants that they possess the absolute legal right to publish such expressions. By submitting content, the user agrees to fully indemnify, defend, and hold harmless Apna Listing Ltd. against any legal claims, defamation actions, tortuous interference lawsuits, demands, or expenses (including full-recovery legal fees) brought forward by a local business entity regarding the contents of that specific submission.

4. COMPLIANCE STANDARDS & DEFAMATION DEFLECTION

To maintain local data integrity across British Columbia, all reviews must remain free of prohibited legal liabilities. Users are strictly barred from publishing any Review or text content that:

  1. Contains verified factual falsehoods, intentional trade libel, or malicious business interference.
  2. Utilizes explicit, profane, abusive, harassing, or sexually overt phrasing.
  3. Exposes private personal information (PII) of employees or owners (such as private home phone numbers or residential addresses) in violation of PIPEDA.
  4. Constitutes conflict-of-interest spam (e.g., business owners reviewing their own business, or competitors leaving fake negative reviews).

5. THE “REPORT AND CORRECT” NOTICE & TAKEDOWN PROTOCOL

If a business operator or private citizen believes that a listing or a user review published on apnalisting.com constitutes defamation, copyright infringement, or a direct breach of Canadian privacy guidelines, they must follow our centralized takedown protocol:

  • Mandatory Written Notification: The complaining party must issue a formal notification to our administrative team at info@apnalisting.com. The notice must contain:
    1. The specific URL string of the disputed review or listing.
    2. An objective, factual explanation detailing the specific text components claimed to be untruthful, defamatory, or in breach of privacy laws.
    3. Valid contact information and proof of corporate identity/business authorization.
  • Neutral Evaluation Period: Upon receipt of a valid written complaint, Apna Listing Ltd. will initiate an internal administrative review. We reserve the absolute, unilateral right to remove, mask, or retain the content based on our internal evaluation of site compliance and community guidelines.
  • Privacy Exception: Notwithstanding the foregoing, requirements for corporate documentation shall not apply to private individuals requesting the immediate suppression or removal of personal residential addresses or personal contact data under applicable Canadian privacy frameworks.

6. JURISDICTION AND LEGAL VENUE

These policies and agreements shall be governed exclusively by, and construed in accordance with, the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any legal proceeding, dispute, or lawsuit arising directly out of your use of the directory platform must be filed exclusively in a court of competent jurisdiction located in Surrey, British Columbia, Canada.
